Brightwild Cancellation Policy & Rental Agreement
Lunara Bay is operated and managed by Brightwild.
Brightwild aims to have a flexible cancellation policy for our guests in order to provide peace of mind in case unexpected events occur prior to your stay that prevent you from traveling.
For guests who book direct from our main company website, our cancellation policy is as follows:
Cancellation Policy
There will be no refund given to guests who cancel within 7 nights of their arrival date.
Guests who cancel outside of the 7-day window prior to their arrival will receive a full refund.
In order to cancel, guests must provide a cancellation request in writing through email.
Third-Party Bookings
Guests who book our vacation rentals through other lodging sites — including, but not limited to, VRBO, Airbnb, and Booking.com — will be subject to the cancellation policy outlined under each respective company’s terms and conditions.
General Terms
By booking a reservation with Brightwild, you are agreeing to abide by the terms and conditions established by Brightwild for your reservation.
All reservations are subject to the terms and conditions of the Brightwild Rental Agreement (defined below) and such other terms and conditions that may be established by Brightwild or the owner of the specific property that is the subject of your reservation.
For your convenience, the following is a brief summary of the terms and conditions set forth in the Brightwild Rental Agreement. In the event of any conflict between the below summary and the Rental Agreement, the terms of the Brightwild Rental Agreement shall control.
Guest Responsibilities
- The property shall not be occupied at any time by more than the number of adults and children listed in your reservation.
- No guests shall engage in illegal activity while in occupancy.
- All guests shall treat neighbors with respect and minimize the possibility of any disturbance to adjacent property owners.
- Quiet hours must be observed between 10 p.m. and 8 a.m.
- Pets are not permitted unless specifically noted in your reservation.
- Renter must be at least 21 years of age (or the specified minimum age required to rent the property, if different). Guests under the minimum age must be accompanied by a parent or legal guardian.
- No smoking is permitted within the unit or home, within any common areas, or anywhere else on the premises.
- No commercial use of the property is permitted. Commercial photography or filming is expressly prohibited.
- Tents or other structures may not be erected on the property.
- Use of charcoal grills is prohibited.
Renter is liable for any damage to the property caused by renter or renter’s family or guests and agrees to accept responsibility for all damage occurring during occupancy. Brightwild is authorized to charge the credit card on file for the cost of correcting any and all such damage.
Cancellation Policy (Summary)
- No refund within 7 days of arrival.
- Full refund outside of the 7-day window.
- Cancellation must be requested in writing via email.
Brightwild Rental Agreement
This Brightwild Rental Agreement (“Agreement”) is between:
- Brightwild – Florida VR, LLC (“Brightwild,” “we,” or “us”), acting for Brightwild and for the owner (“Owner”) of the Property; and
- The person who is the responsible renter of the Property (“Renter” or “you”).
This Agreement governs the rental of the property specified in a confirmed reservation (the “Property”).
Section 1. Effective Date; Definitions
Material Part of Confirmed Reservation; Effective Date
This Agreement is a material part of the confirmed reservation and is effective immediately upon your booking of the Property. By booking, Renter acknowledges and agrees to be bound by all terms, conditions, and policies in this Agreement, including any Property-Specific Terms (“Terms”).
Definition: Property-Specific Terms
Certain jurisdictions, resorts, and Owners of specific properties require renters to agree to additional terms and conditions (“Property-Specific Terms”). We will inform you during the reservation process if any apply. In case of conflict, the Property-Specific Terms control.
Definition: OTA Terms
If booking through a third-party (e.g., Airbnb, HomeAway, VRBO), your booking may be subject to that party’s terms and conditions (“OTA Terms”). If any OTA Terms conflict with this Agreement, the OTA Terms control.
Section 2. Rental Policies and General Terms
Minimum Age for Rental
The “Minimum Age” is specified in the Property-Specific Terms, or 21 years of age if not otherwise noted. All guests under the Minimum Age must be accompanied by a parent or legal guardian.
Renter as Responsible Party
Renter must occupy the Property for the entire duration of the rental and is responsible for all actions of family members, guests, and invitees (“Occupants”).
Occupancy Restrictions
The number of Occupants cannot exceed the listed maximum without Brightwild’s written approval. The Property may not be used as a permanent residence.
Smoking Prohibited
Smoking is prohibited anywhere on the Property, including porches, decks, and outdoor areas.
Animals
Animals are permitted in accordance with the property’s pet policy. All animals must be disclosed prior to arrival and are subject to the applicable pet fee. This policy does not apply to authorized service animals as required by law. Emotional support animals not considered service animals fall under the standard pet policy, requiring prior written approval and payment of the pet fee.
Conduct and Care
Guests must treat the Property with care and respect, lock doors and windows when away, and observe all quiet hours and parking restrictions.
No Commercial Use or Events
Commercial use, photography, filming, tents, or structures are prohibited without prior written approval. Charcoal grills are not allowed.
Compliance with Law
Guests must comply with all applicable laws and may not use the Property for any criminal activity.
Section 3. Reservation Rules
Cancellation Policy
No refund will be issued for cancellations within 7 days of arrival.
Guests who cancel outside the 7-day window will receive a full refund.
Cancellations must be requested in writing via email.
Early Check-In / Late Check-Out
Subject to availability and may incur additional charges. Late check-out without approval may result in a charge up to one night’s rental.
Maintenance & Housekeeping
Guests agree to report any issues promptly and allow Brightwild reasonable time to address them. No refunds will be issued unless Brightwild is given the opportunity to remedy the issue.
Section 4. Payment Terms; Payment Fraud
Payment must be from an authorized account. Brightwild reserves the right to request additional proof of authorization or alternative payment if fraud is suspected.
Section 5. Breach; Damage
Failure to comply with the Terms constitutes a breach and may result in immediate removal without refund. Renters are responsible for any damage, fines, or excessive cleaning costs.
Section 6. Governing Law; Dispute Resolution
Governing Law: State of Florida.
Arbitration: Disputes will be settled by arbitration under the American Arbitration Association’s Consumer Arbitration Rules.
Exceptions: Small claims court or intellectual property disputes.
Class Action Waiver: Disputes will be resolved individually; jury trial waived.
Attorneys’ Fees: Prevailing party entitled to recover reasonable attorneys’ fees.
Section 7. Acknowledgment & Disclaimer; Limitation of Liability
Guests acknowledge potential risks inherent to the Property (e.g., wildlife, stairs, pools) and assume responsibility for their use.
Disclaimer of Warranties: Brightwild and the Owner disclaim all warranties of safety, fitness, or suitability.
Limitation of Liability: Neither Brightwild nor the Owner shall be liable for any indirect, incidental, or consequential damages, or for personal injury or illness arising from the stay.
Section 8. Indemnification
Guests agree to indemnify and hold harmless Brightwild and the Owner from all claims or damages resulting from guest actions or omissions.
Section 9. Substitution of Property
If the reserved Property becomes unavailable, Brightwild may substitute a comparable property or provide a full refund.
Section 10. Assignment
Brightwild may assign its rights and obligations under this Agreement without Renter’s consent to any successor entity assuming its responsibilities.
